What is Patent Pending?

Patent pending may be used on a product after the inventor filed for a patent (provisional or non-provisional patent) and is waiting to see if the patent is granted by the US Patent Office.

Applying the “patent pending” phrase to a product when no patent application has been filed with the US Patent Office can result in a fine or loss of later filed patent rights. An inventor can only use the term “patent pending” if a patent application has actually been filed with the patent office in the US.
